Terms of Service

• A booking is confirmed when the retainer is paid — not when the form is submitted. Until then the date is not held.
• The retainer is non-refundable. It comes off your session fee; it is not an extra charge.
• The balance is due on or before your session date. For birth packages, the balance is due by 37 weeks.
• Sessions must be booked at least 48 hours ahead.

• You may reschedule once, with at least 48 hours’ notice, and your retainer moves with you.
• Cancelling, or not arriving, forfeits the retainer.
• Newborn and birth sessions are the exception. Babies do not keep appointments. If your baby arrives early, late, or the session has to move for a medical reason, we will move it without penalty.
• If Diana has to cancel — illness, an emergency, weather that makes an outdoor session impossible — you choose between a new date and a full refund of everything paid, including the retainer.

Birth photography is an on-call arrangement, not an appointment. Diana goes on call two weeks before your due date and stays reachable until your baby arrives.

• Call when labour is established. We will get there as quickly as we reasonably can.
• Births are unpredictable and so is traffic. In the rare case Diana cannot arrive before the birth, she will stay to photograph the first hours, and we will agree a fair adjustment.
• We follow the instructions of your medical team at all times. If hospital staff ask us to stop photographing or to leave, we comply immediately and without argument.

• Arriving late shortens your session; it does not extend it, as the time after yours may belong to someone else.
• The number of people included is listed with your package. Extra people may incur an additional charge.
• Creative decisions — posing, lighting, selection, and editing style — rest with the photographer. You are hiring a particular way of seeing.

• Galleries are delivered online and stay open for 90 days. Download everything you want before it closes, and keep your own backup — we cannot guarantee we can recover a gallery once it has expired.
• Where your package includes a set number of images, you choose which ones.
• We edit every delivered image in the studio’s style. We do not release unedited or raw files.
• Your gallery is yours. Please do not share your password — anyone with it can see photographs of your family.

Diana Garzon retains copyright in every photograph, which is how copyright works for commissioned photography. What you receive is a licence — a broad one.

You may print your images as often as you like for yourself, your family and your friends; post them anywhere you want; send them to whoever you want; and use them as any profile or announcement image. You never need to ask, and you never owe us anything for it.

You may not sell them, license them to a business, or enter them into competitions as your own work. You may not crop out or remove a watermark from a preview, and please do not apply filters or re-edit them before posting — the edit is the work you commissioned. A credit when you post is always appreciated and never required.

We will not use your photographs in our portfolio, on social media, in advertising, or anywhere else public unless you have given written permission in your session agreement. That permission is separate from these terms and entirely optional — declining it changes nothing about your session or its price.

If you gave permission and later change your mind, tell us and we will remove the images from everything we control. We cannot retrieve what others have already shared or printed.

• Prints are made to order by a professional laboratory and shipped to you. Production and delivery times are estimates.
• Because each item is made for you, orders cannot be cancelled once production starts, and are not returnable for a change of mind.
• If an item arrives damaged or is wrong, tell us within 14 days and we will replace it.
• Screens vary. Colour on a print will not match your phone exactly, and this is not a fault.

Payments are handled by Stripe. Prices are in US dollars and include any sales tax where it applies. A failed or reversed payment may pause access to your gallery until it is resolved.

We take the care you would expect of a professional studio, and we carry backups of your images while your gallery is open. But equipment fails and files corrupt. If your images are lost before delivery through something on our side, our liability is limited to a refund of what you have paid and, where possible, a reshoot. We are not liable for indirect or consequential losses.

Nothing here limits any liability that cannot be limited by law.

These terms are governed by the laws of the State of Florida, and any dispute belongs to the courts of Hillsborough County, Florida.

We may update these terms. The version that applies to your session is the one published when you booked.
